These Terms & Conditions apply to the use of the Disaster to Delight Dog Training website and to purchases, bookings and services supplied by Disaster to Delight Dog Training (“D2D”, “we”, “our” or “us”).

By purchasing a product or service, making a booking, enrolling in an online course or using paid D2D content, you agree to the terms applicable to that purchase or service.

Additional terms may apply to particular programs, group classes, events or services. Where you enter into a specific D2D Program Agreement or other written agreement, that agreement forms part of the terms governing that service.

2. Our Services

D2D may offer services and products including:

  • private dog training;

  • behaviour training and education;

The exact inclusions, price, delivery method and duration of a product or service will be described on the relevant booking, sales, course or program page or within a specific agreement.

3. Training Approach and Client Participation

Dog training is an active process requiring participation from both the handler and dog.

Where D2D provides exercises, instructions or recommendations, clients are expected to practise and apply those skills appropriately between sessions.

Progress may depend on many factors including the individual dog, behavioural history, health, environment, handler consistency, household participation, frequency and quality of practice, previous learning and exposure to relevant situations.

D2D will provide services diligently and professionally, but specific behavioural or training results cannot be guaranteed.

4. Veterinary and Health Matters

D2D provides dog training and behaviour education. D2D does not diagnose or treat veterinary medical conditions.

Pain, illness, medication effects or other medical factors may contribute to behavioural changes.

Where D2D reasonably believes veterinary assessment is appropriate, we may recommend that you consult your veterinarian before commencing or continuing particular training.

You remain responsible for your dog's veterinary care and for informing D2D of relevant health conditions, injuries, medications or limitations that may affect safe participation.

5. Information You Provide

You agree to provide information that is accurate and reasonably complete when making enquiries, bookings, purchases or completing training documents.

This may include information about your contact details, your dog, behaviour history, aggression or bite history, health considerations, household circumstances, training goals and other matters relevant to safe and appropriate service delivery.

Failure to disclose material safety or behaviour information may affect D2D's ability to provide a service and may result in modification, postponement or termination of training where reasonably necessary.

6. Bookings and Confirmation

Availability shown online does not necessarily guarantee a booking until any required booking, payment, deposit, form or agreement requirements have been satisfied.

Where a program requires an agreement, questionnaire, deposit or other onboarding requirement, the booking or program place may remain conditional until those requirements are completed.

Training dates and times may be confirmed separately.

7. Prices and Payment

Prices are shown in Australian dollars unless stated otherwise.

The amount payable and any applicable deposit, instalment or payment arrangement will be stated at the time of purchase, booking or within the relevant service agreement.

Unless otherwise agreed in writing, required program fees must be paid in accordance with the payment terms provided by D2D.

A failure to make an agreed payment may result in access, appointments or services being suspended until the matter is resolved.

8. Cancellations and Rescheduling

Cancellation and rescheduling requirements vary depending on the service purchased.

The current D2D Refund & Cancellation Policy forms part of these Terms & Conditions.

Individual programs, events or services may also have additional cancellation requirements disclosed before purchase or contained within a specific agreement.

9. Changes Made by D2D

Occasionally D2D may need to alter a session because of severe or unsafe weather, excessive heat, illness or emergency, unsafe training conditions, venue availability, environmental hazards or circumstances outside reasonable control.

Depending on the circumstances, D2D may modify, relocate, shorten, postpone or reschedule an affected session.

Where D2D cannot provide a purchased service, we will work with the client to provide an appropriate remedy having regard to the circumstances and applicable Australian Consumer Law.

10. Safety

Dog training involves inherent risks.

Clients are responsible for maintaining reasonable control of their dog and following safety directions provided by D2D.

For group or public-space training, additional safety requirements may apply, including requirements relating to leads and training equipment, appropriate spacing, dog-to-dog interactions, interaction with members of the public, children, environmental hazards, dogs that are over threshold, weather and heat.

D2D may modify or stop an activity where we reasonably consider continuing would pose an unacceptable safety or welfare risk.

11. Equipment

Where training equipment is recommended or supplied, it must be used in accordance with the instructions provided.

The client is responsible for appropriately maintaining equipment in their possession and for loss or damage beyond ordinary wear and tear where applicable.

Equipment should not be used in a way that is inconsistent with D2D instructions.

12. Behaviour and Right to End a Session

D2D may stop, postpone or terminate a training activity or service where reasonably necessary because:

  • a dog presents an unacceptable safety risk;

  • the training environment is unsafe or unsuitable;

  • required safety instructions are repeatedly disregarded;

  • relevant behaviour or health information has not been disclosed;

  • a person behaves in an abusive, threatening or seriously inappropriate manner; or

  • continuing would compromise animal welfare or public safety.

Where a service is terminated, any refund or other remedy will depend on the circumstances and applicable law.

13. Online Courses and Digital Products

Online courses and digital resources are supplied for personal educational use unless expressly stated otherwise.

Purchasing a course provides you with a personal, limited, non-transferable right to access and use the content according to the access conditions stated at purchase.

You must not, without written permission:

  • share your login with another person;

  • reproduce substantial parts of a course or resource;

  • distribute course files;

  • upload paid D2D material to another platform;

  • sell, sublicense or commercially exploit course content;

  • record, copy or republish paid lessons; or

  • make D2D materials publicly available.

Members of the same household may apply training knowledge with their own dog, but this does not permit redistribution of the course itself.

14. Course Access

Course access periods, where applicable, will be stated on the product or enrolment information.

Where a course is sold with ongoing or lifetime-style access, access remains subject to the continued operation of the relevant product and platform and any specific representations made at the time of purchase.

D2D may update, reorganise or improve course content from time to time.

We will not intentionally remove paid access without reasonable cause or contrary to applicable consumer rights.

15. Member Accounts

You are responsible for maintaining the confidentiality of your login details, ensuring information associated with your account is accurate, preventing unauthorised use of your account and notifying D2D if you believe your account has been compromised.

D2D may suspend access where there is reasonable evidence of account sharing, misuse, unauthorised distribution or another serious breach of these Terms.

16. Educational Nature of Online Content

Online training material provides general education and instruction.

A course cannot assess every individual dog, household or behavioural situation.

You are responsible for deciding whether an exercise is appropriate for your dog and environment and for seeking individual professional or veterinary advice where needed.

If your dog displays aggression, significant fear, sudden behavioural change, injury, illness or behaviour that creates a safety concern, individual assessment may be more appropriate than relying solely on general course material.

17. Intellectual Property

Unless otherwise stated, D2D owns or is licensed to use the intellectual property contained in its courses, videos, written resources, downloads, worksheets, training materials, graphics, branding, photographs, media and website content.

Purchase of a D2D product does not transfer ownership of that intellectual property.

You may use purchased resources personally for their intended purpose but may not reproduce or commercially distribute them without written permission.

18. Media Consent

Photography or video may be captured during some training services.

Where media use requires consent, it will be addressed through the relevant service agreement or permission process.

Where consent has been given, D2D may use approved media for training records, education, website content or marketing.

Consent may be withdrawn in writing for future use, subject to material already lawfully published or used before withdrawal.

19. Third-Party Services and Links

D2D may use third-party providers for services such as bookings, payments, course delivery, website hosting, email, video conferencing and cloud storage.

Our website or courses may also link to third-party resources.

Third-party services operate under their own terms, privacy practices and technical systems. D2D is not responsible for independent third-party services outside our reasonable control.

20. Liability and Risk

Working with dogs involves inherent and sometimes unpredictable risks.

Clients remain responsible for the supervision, management and conduct of their dog and for loss, damage or injury caused by their dog to the extent permitted by law.

Nothing in these Terms excludes, restricts or modifies any right, guarantee, remedy or liability that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

21. Australian Consumer Law

Our products and services come with rights and consumer guarantees that may apply under the Australian Consumer Law.

Nothing in these Terms is intended to exclude, restrict or modify those rights where doing so would be unlawful.

Depending on the circumstances, a consumer may be entitled to a remedy where goods or services fail to meet an applicable consumer guarantee.

22. Reviews, Testimonials and Feedback

If you voluntarily provide feedback, a review or testimonial, D2D may ask permission to reproduce it for business or marketing purposes.

We will not knowingly alter feedback in a way that materially misrepresents the client's experience.

23. Complaints and Disputes

If a concern or dispute arises, we ask that you contact D2D so the matter can first be addressed directly and in good faith.

Where a matter cannot be resolved directly, the parties retain any rights available under applicable law.

24. Governing Law

These Terms are governed by the laws applicable in South Australia and Australia.

Nothing in this clause limits any rights a consumer may have under applicable consumer protection legislation.

25. Changes to These Terms

D2D may update these Terms & Conditions where reasonably necessary because of changes to our services, technology, business practices or legal requirements.

Changes will apply prospectively unless otherwise permitted or required by law.

The version applicable to an existing purchase will also be subject to any specific terms agreed at the time of purchase.

Refund & Cancellation Policy

This policy explains cancellation, rescheduling and refund arrangements for services and products purchased from Disaster to Delight Dog Training (“D2D”).

Nothing in this policy excludes or limits rights or remedies available under the Australian Consumer Law.

1. Private Training Appointments

Where more than 24 hours' notice is provided, a private training appointment may be cancelled or rescheduled without a cancellation penalty.

Where less than 24 hours' notice is provided:

  • for a first late cancellation, D2D may allow the appointment to be rescheduled without penalty at our discretion;

  • repeated late cancellations may result in the session being forfeited; and

  • very late cancellations or failure to attend may result in the session being treated as used.

We understand genuine emergencies occur and will consider exceptional circumstances reasonably and case by case.

2. Training Programs and Packages

Training programs reserve both training time and program capacity.

Once a program has commenced, refunds are not ordinarily provided simply because a client:

  • changes their mind;

  • decides not to continue;

  • does not complete recommended practice;

  • no longer wishes to use remaining sessions; or

  • has scheduling difficulties unrelated to D2D's ability to provide the service.

Where illness, injury, emergency, veterinary advice or another significant circumstance prevents continuation, contact D2D as soon as possible.

Depending on the circumstances, options may include rescheduling, pausing the program, modifying delivery, transferring remaining service value where appropriate or another reasonable solution.

Any applicable rights under Australian Consumer Law continue to apply.

3. Missed Sessions

A session that is missed without sufficient notice may be forfeited.

If a client does not attend an appointment and has not contacted D2D, D2D is not required to provide an additional replacement session solely because the appointment was missed.

Exceptional circumstances may be considered at D2D's discretion.

4. Late Arrival

If a client arrives late, the session may still finish at the originally scheduled time where another commitment follows.

The full session fee may still apply.

Where D2D is responsible for a significant delay, reasonable arrangements will be made so the client does not lose purchased training time.

5. Group Classes, Workshops and Public Training Sessions

Group services involve reserved places, scheduled locations and group planning.

Cancellation and transfer conditions specific to an event may be stated on the relevant booking page.

Where unsafe conditions, weather or excessive heat affect a session, D2D may modify the activity, relocate it, shorten it, postpone it or reschedule it.

Where D2D cancels a session and cannot provide an appropriate replacement or alternative, an appropriate remedy will be provided having regard to the circumstances and applicable consumer law.

6. Weather and Heat

Outdoor and public-space dog training is affected by environmental conditions.

D2D considers dog and human welfare when deciding whether training can proceed safely.

Where weather makes the planned activity unsuitable, modification or rescheduling is not considered a client cancellation.

Clients will be advised of relevant changes as soon as reasonably practicable.

7. Online Courses and Digital Products

Because online courses and downloadable digital products may provide immediate access to intellectual property and educational materials, a change-of-mind refund is not ordinarily offered after access has been supplied, except where:

  • the product has not been supplied as described;

  • there is a significant technical or access problem that D2D cannot remedy within a reasonable time;

  • the product or service fails to meet an applicable consumer guarantee; or

  • a refund or other remedy is otherwise required by law.

Please contact D2D if you accidentally purchase the wrong product before accessing or downloading the content. Where possible, we may be able to transfer the purchase to the correct product rather than issue a refund.

8. Difficulty Accessing an Online Course

If you cannot access a purchased course, please contact D2D before treating the issue as a failed purchase.

We will first attempt to identify and rectify reasonable access problems, including account setup issues, incorrect login information, enrolment errors and platform access problems within our control.

Problems caused solely by a user's internet connection, device settings or unsupported technology do not automatically entitle the purchaser to a refund, although we will provide reasonable assistance where possible.

9. Physical Products

If D2D sells physical products, applicable Australian Consumer Law rights continue to apply.

A remedy may be available where a product is faulty, unsafe, not of acceptable quality, does not match its description or otherwise fails an applicable consumer guarantee.

Change-of-mind returns, where offered, may be subject to separate conditions disclosed at purchase.

10. Deposits

Where a deposit is required to reserve a service or program, its purpose and treatment will be disclosed at the time of booking or in the relevant agreement.

Where a deposit forms part of the total program price, it will be credited toward that price.

Any cancellation or refund entitlement relating to a deposit will be assessed according to the terms disclosed at purchase, services already supplied, reserved appointments or program capacity, the reason for cancellation and applicable Australian Consumer Law.

11. D2D Cancellation

If D2D is unable to provide a booked service because of trainer illness, emergency or another circumstance within our responsibility, we will ordinarily offer rescheduling or another reasonable alternative.

Where the service cannot reasonably be supplied, an appropriate refund or other remedy will be provided where required.

12. Dog Health, Welfare or Safety

A session may need to be altered, postponed or discontinued if the dog is ill or injured, participation is considered unsafe, veterinary assessment is recommended, conditions are unsafe or continuing would create an unacceptable welfare or safety concern.

The appropriate financial outcome will depend on the circumstances, including whether services have already been provided and whether the issue could reasonably have been disclosed before the session.

13. Termination for Serious Safety or Conduct Issues

D2D may discontinue a session or service where a person behaves abusively, seriously breaches safety requirements or where undisclosed information creates a significant risk.

A refund is not automatically payable where termination results from a serious breach by the client.

This does not affect rights that cannot lawfully be excluded.

14. Australian Consumer Law

This policy does not replace or restrict your rights under the Australian Consumer Law.

Consumer guarantees apply automatically to qualifying goods and services and cannot be removed by a business policy.

Where a product or service does not meet an applicable consumer guarantee, the remedy available will depend on the nature and seriousness of the problem and may include rectification, replacement, cancellation, refund or compensation as provided by law.

15. Requesting a Cancellation, Reschedule or Refund

Please contact D2D as soon as possible and provide your name, your dog's name where relevant, the service, program or product purchased, the booking or purchase date, what you are requesting and relevant information about the circumstances.

5. Information About Your Dog

Effective and safe dog training may require information about your dog's behaviour, training history, environment, previous incidents and relevant health considerations.

Please provide information that is accurate and complete. If circumstances change in a way that could affect training or safety, we ask that you advise D2D.

Information about a dog may also relate to identifiable people within a household. Where this occurs, we treat that information with appropriate care.

6. Online Platforms and Service Providers

D2D uses third-party technology and service providers to operate parts of the business. These may include providers used for website hosting, appointment scheduling, online course and member access, payment processing, email and marketing communications, online forms, cloud storage, video conferencing, analytics and business administration.

Personal information may therefore be processed or stored by these providers in accordance with their own privacy policies and data handling practices.

Some providers may store or process information outside Australia.

We take reasonable steps when selecting and using service providers, but D2D does not control the independent privacy practices of third-party platforms.

7. Payments

Payment information may be processed by third-party payment providers.

D2D does not generally receive or store your complete credit or debit card details when a third-party payment processor handles the transaction. The payment provider's own privacy and security practices apply to information submitted directly through its systems.

8. MemberVault and Online Courses

When you purchase or access a D2D online course or digital program, information may be collected or processed to create and manage your account, provide access to purchased content, record enrolment and course progress, communicate important information about your course, provide support and administer payments, access periods or product entitlements.

You are responsible for keeping your account login details secure and notifying D2D if you believe your account has been accessed without permission.

9. Email Marketing

Where you subscribe to D2D marketing communications, we may use your name, email address and relevant preferences to send training information, updates, resources, offers or news.

You may unsubscribe from marketing communications at any time by using the unsubscribe link provided in the communication or by contacting us.

Administrative communications relating to an existing booking, purchase, account or service are separate from marketing communications and may still be sent where necessary.

10. Photographs and Video

Training sessions may occasionally be photographed or recorded for purposes such as training records, education or marketing.

Where media consent forms part of your service agreement, your choices will be managed in accordance with that agreement.

Consent for future use may be withdrawn by contacting D2D in writing. Withdrawal does not necessarily require D2D to recall or remove material lawfully published before the withdrawal was received.

11. Disclosure of Information

We do not sell personal information.

We may disclose information where reasonably necessary to service providers supporting our business operations, payment processors, professional advisers, authorities or regulators where required by law, or emergency, veterinary or other appropriate services where reasonably necessary in connection with an urgent safety matter.

We may also disclose information where you have authorised us to do so.

12. Data Security

D2D takes reasonable steps to protect information from misuse, interference, loss, unauthorised access, modification or disclosure.

However, no website, internet transmission, cloud service or electronic storage system can be guaranteed to be completely secure.

You should also take reasonable precautions to protect your passwords, devices and account information.

13. Retention of Information

We may retain personal information for as long as reasonably necessary for providing services, maintaining client and training records, managing transactions and accounts, meeting legal, insurance, taxation or recordkeeping obligations, and resolving complaints or disputes.

Information that is no longer reasonably required may be deleted, destroyed or de-identified where appropriate.

14. Access and Correction

You may contact D2D if you would like to request access to personal information we hold about you or believe information should be corrected.

We may need to verify your identity before providing access or making changes.
